1. Who you are contracting with

These terms are an agreement between you and Mainstreet Live, trading as Mainstreet ("we", "us"), the provider of the Mainstreet landing page builder (the "Service"). By creating an account, using or continuing to use the Service, you agree to these terms. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you confirm you have authority to bind that business. If you use it as an individual, you confirm you are of legal age in your country.

2. The Service

Mainstreet lets you build, host and publish landing pages for a local business, with optional catalogues, ordering, appointment requests, analytics and a custom domain, depending on your plan. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

3. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account.

4. Acceptable use

You must not misuse the Service. In particular you must not:

  • use the Service for anything unlawful, or to publish unlawful, deceptive or harmful content;
  • commit fraud, send spam, or impersonate another business or person;
  • infringe anyone's intellectual property or other rights;
  • interfere with the security or integrity of the Service, including uploading malware, probing or scanning systems, bypassing limits, or scraping at scale;
  • reverse engineer, resell or redistribute the Service, or circumvent technical limitations.

5. Your content

You keep ownership of the text, images and other content you upload. You grant us a limited licence to host, store, reproduce and display that content solely to provide the Service to you. You are responsible for having the rights to everything you upload, and for the goods and services you sell through your pages.

If you believe content published through Mainstreet infringes your rights, contact us through our support page with details. We may remove or restrict content, refuse to publish it, and suspend accounts that repeatedly infringe.

6. Our intellectual property

We retain all rights in the Service, including the software, templates, documentation and Mainstreet branding. Nothing in these terms transfers ownership of that intellectual property to you.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing frequency, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms. Paid plans renew automatically until cancelled. See our Refund Policy.

Where you take payments from your own customers through a payment gateway you connect, that money and that relationship are yours: you are the seller of those goods and services, and you are responsible for fulfilment, taxes and refunds to your customers.

8. Service level and warranties

We work to keep the Service available, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service and cancel your subscription at any time. On termination, your published pages are taken offline; you may export or request a copy of your content for 30 days, after which it may be deleted.

10. Liability

To the extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.

11. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.

12. General

You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. These terms are governed by the laws of the seller's jurisdiction, and disputes will be heard by its courts. We may update these terms; continued use after an update means you accept the revised version.
